Objet du projet de d’arrêté :
Le décret n° 2022-422 du 25 mars 2022 prévoit la mise en place d’un dispositif de rattrapage permettant de soumettre à évaluation environnementale des projets qui, bien que situés en-deçà des seuils de la nomenclature annexée à l’article R.122-2 du code de l’environnement, seraient susceptibles d’avoir des incidences notables sur l’environnement ou la santé humaine. Ce dispositif permet à l’autorité compétente pour autoriser ou recevoir la déclaration d’un projet de soumettre un tel projet à examen au cas par cas s’il lui apparaît que ce projet est susceptible d’avoir des incidences notables sur l’environnement ou la santé humaine.
Parallèlement à la clause-filet, le décret prévoit la possibilité, pour le porteur de projet, de saisir volontairement l’autorité chargée de l’examen au cas par cas, lorsque son projet se situe en-deçà des seuils de la nomenclature.
En conséquence le projet d’arrêté modifie le formulaire de la « demande d’examen au cas par cas » et la notice explicative pour les demandes d’examen au cas par cas afin d’y intégrer ces deux nouvelles modalités.
Le décret n°2020-844 du 3 juillet 2020 distingue autorité chargée de l’examen au cas par cas et autorité environnementale.
Le projet d’arrêté intègre cette distinction dans le formulaire de la « demande d’examen au cas par cas » et la notice explicative pour les demandes d’examen au cas par cas.
Dans son avis motivé du 15 juillet 2022, la Commission considère que la transposition de la directive 2011/92/UE (modifiée par la directive (UE) 2014/52) est non-conforme en ce qu’elle ne requiert pas que le maître d’ouvrage tienne compte des résultats disponibles d’autres évaluations pertinentes des incidences sur l’environnement requises au titre d’autres législations applicables notamment au regard du formulaire Cerfa d’examen au cas par cas qui ne mentionne que la législation de l’Union relatives aux sites Natura 2000.
Le projet d’arrêté intègre clairement cette exigence dans le formulaire de la « demande d’examen au cas par cas » et dans la notice explicative pour les demandes d’examen au cas par cas.
Le projet d’arrêté apporte des précisions quant aux informations à fournir par le maître d’ouvrage ou le pétitionnaire dans le formulaire concernant :
le document d’urbanisme en vigueur sur la zone d’implantation du projet ainsi que les zonages auxquels le projet est soumis ;
la description des mesures prévues pour éviter ou réduire les effets négatifs notables du projet sur l’environnement et les conclusions en matière de potentiels impacts résiduels.
